If the landlord withholds in bad faith
Treble (3x) damages for any security deposit money withheld without reasonable justification.
Cap 1 month (up to 2 months for a tenant with a felony conviction or prior lease-violation judgment). Landlord must give a signed condition statement at lease signing (§ 47-16-07.2). Interest required only if occupancy is 9 months or longer, held in insured interest-bearing account.
