If the landlord withholds in bad faith
double the amount of the deposit wrongfully withheld plus reasonable attorney's fees and court costs; tenant must give 7 days' written notice of intent to sue; burden on landlord to show withholding was not wrongful
Written lease: return or itemized statement within the lease-stated period, not exceeding 30 days. Tenancy at will: 21 days after the later of termination or surrender/acceptance (§ 6033(2)). Cap 2 months' rent (§ 6032). Deposit held separate from landlord's assets; no interest required.
